Legal hold as a distinct capability alongside discovery is the structure worth understanding, because the two are separated by time in a way that creates real exposure.

A legal hold begins when litigation becomes reasonably anticipated, which is frequently long before any case is filed. From that moment the organisation must preserve relevant material and stop routine deletion, and it must be able to demonstrate later that it did so.

Discovery happens afterwards, sometimes years afterwards. What matters at that point is whether the preservation actually worked, and the failures are almost always administrative rather than technical: a custodian never received the notice, someone left the company and their mailbox was deleted on the standard schedule, or nobody tracked whether recipients acknowledged the hold.

Those failures produce sanctions, and sanctions for failing to preserve are frequently more damaging than the underlying case, because a court may instruct a jury to assume the missing evidence was unfavourable.

A central command hub with notices, reminders and tracking addresses exactly that, since the defensibility of a hold rests on evidence of the process rather than on good intentions.

Automation from collection through production is the other half. Discovery cost is driven by volume, and most collected material is irrelevant. Automating culling before human review is where the money is saved, since review by lawyers is by far the largest line item in any discovery budget.
